Mind you, If you are suggesting that it shouldn't happen or that someone was breaking the rules, how many fines should Bojo have received. There is his Birthday, Downing Strest quiz night and the Garden Party where drink was in evidence, all during "full lockdown" all involving Bojo, where people were supposed to be working from home and not mixing ?
If Starmer has broken the rules he should be dealt with accordingly

Why the comparison? If KS has committed an individual breach then he should be investigated by the Police no matter what is happening to BJ.

If so, deal with this in line with the rules at the time - no problem.
As for the cake and happy birthday as if this was the extent of the multiple gatherings at No 10

Why are you ignoring the, "remembering the levels of restrictions that were in place at the time" bit? Is it because once you account for that this made-up story stops being a thing?
