The UKBA would say that every application is treated on it's own merits.
I think the first refusal (if on the basis of his conviction) was a reaction to the apparent clampdown by the new entry clearance manager.
There is an element of discretion in the rule that we think was used and a better made case, supported by the club and relevant bodies in Aus should therefore have a better chance of success. Nothing guaranteed, mind. As I've said elsewhere if this gets turned down again, I'd recommend the club contact Bradford about Bird then challenge the refusal through every means possible, involving MPs and Ministers if necessary.
