possibly... but things like, leaving your computer unlocked while getting a drink. leaving paper on your desk.. all considered breach of data protection. If they upheld it to what your saying there would be nobody left. mistakes happen.

So lock the PC when you go for a drink and file the paper away in a lockable cabinet. It really doesnt take much to be adherant and if its policy driven by data protection legislation an instance like this should only be minor punishment. Punishments such as dismissal are linked to giving the information external to the company for mis-use, like Silverwood has done.

I understand, just saying these things happen from time to time. I dont imagin for one minute silverwood thought what he was doing was wrong. If you do something for the right reasons? hmm arguable. I think he will get off with a fine.

From the report though he didnt just leave his PC unlocked did he? He willfully gave fellow employees details to an external party. I would be instantly dismissed for that!

correct which is wrong. But he didn't pass them on to just anybody. It was a trade union. So I believe he thought he was doing right. Therefor I would have thought a fine and suspension is adequate

Trade Unions would need to request and personnel data from HR. Silverwood should know that, he is in hot water and i wouldnt be surprised if he is dismissed.

yeah i just cant imagine why he would do it purposly if he knew he would get it trouble for it. Anyway I hope he stays, better then most the refs out there
